Jefferson County Conservator Secures Over Half-Million Dollar Judgment in Elder Abuse Case
Hand Arendall Harrison Sale attorney Gregory H. Hawley, serving as Jefferson County Conservator, has successfully obtained a $510,000 judgment on behalf of an elderly protected individual. This case, a poignant example of the legal system’s fight against financial exploitation of the elderly, was rigorously pursued by firm attorneys W. Alan Duke, Jr. and Nicole B. Bracey.
The judgment highlights the vulnerabilities of the elderly to financial exploitation and the need for vigilant legal protection. This case sets a significant precedent in the enforcement of laws designed to protect the elderly from such abuses.
Hawley, who has served as a Jefferson County Guardian and Conservator since 2013, expressed his satisfaction with the court’s decision, stating, “This judgment is not just a win in terms of financial restitution for the victim but a clear message that our community and our courts stand firmly against the exploitation of our elderly population. We are committed to using every legal avenue available to protect the rights and dignity of protected persons in Jefferson County.”
Duke, the attorney who represented Hawley in this case, emphasized the importance of this victory, “Hand Arendall Harrison Sale is deeply committed to the welfare of persons in need of protection. This case underlines the importance of the Elder Abuse Protection Order and Enforcement Act and showcases our dedication to fighting for those who may not be able to defend themselves. We hope this serves as a deterrent to those who might contemplate exploiting vulnerable members of our society.”
The case serves as a critical reminder of the importance of safeguarding the elderly from financial exploitation and abuse. It also highlights the role of legal professionals and conservators in protecting the rights and well-being of the elderly, ensuring they live their later years in dignity and that their funds needed for health, support, education, or maintenance are secure.
In addition to the civil remedy obtained in this case, the U.S. Attorney’s Office for the Northern District of Alabama announced a two-count indictment filed in U.S. District Court for charges of wire fraud.
